This Privacy Policy governs the collection, use, storage, processing, and disclosure of personal data on Brands Forever (Mobile App and Web via BrandsForever.in or www.BrandsForever.in collectively called as BrandsForever hereafter), operated by Gotieup Infotech Private Limited (CIN: U62090RJ2024PTC096326). This policy is drafted in compliance with the Information Technology Act, 2000, Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the Digital Personal Data Protection Act, 2023 (DPDP Act).

1. Platform Nature & Intermediary Status

BrandsForever is a technology-based business listing and discovery platform. BrandsForever acts strictly as an intermediary under Section 2(1)(w) of the Information Technology Act, 2000 and is entitled to safe-harbor protection under Section 79.

BrandsForever does not own, control, or operate the businesses listed on the platform and does not guarantee the accuracy of vendor-provided information.

2. Eligibility

Users must be at least 13 years of age to use the platform. Users below 18 years are considered minors and must use the platform under parental or legal guardian supervision. BrandsForever does not knowingly collect personal data of children below 13 years.

Gender and year of birth are collected only for demographic analysis, platform improvement, fraud prevention, and compliance purposes and are not publicly displayed.

Interaction history with listings

IP address
Device type, operating system, browser type
App usage data, logs, crash reports
Cookies and similar tracking technologies
Approximate location derived from IP address

IP address and device data are used only for security, fraud prevention, analytics, and compliance purposes.

4. Information Collected from Businesses (Vendors)

Vendors voluntarily submit business-related information which is publicly displayed on the platform. This may include:

Business or brand name
GST number (if applicable)
Business description
Contact details (phone, WhatsApp, email)
Full business address
Website and app download links
Google Business profile link
Business operating hours
Social media links
Images, logos, banners, and videos
Categories, FAQs, enquiry preferences

Vendors represent and warrant that all information submitted is accurate, lawfully owned, and compliant with applicable laws. Vendors agree to indemnify and hold harmless BrandsForever from any claims arising from incorrect or unlawful information.

6. Reviews & Sharing of User Contact Information

Only verified users may submit reviews. Before submitting a review, users are informed that their name and mobile number will be shared with the reviewed business. Submission of a review constitutes explicit and informed consent.

Vendors may use user contact details strictly for:

Addressing the specific review
Service resolution
Lawful communication directly related to the reviewed transaction

Vendors are strictly prohibited from using user contact information for marketing, promotional, resale, or unrelated purposes. BrandsForever shall not be responsible for any misuse of such data by vendors.

7. User-Generated Content Disclaimer

Reviews represent the personal opinions of users. BrandsForever does not endorse, verify, or guarantee the accuracy of user-generated content. BrandsForever reserves the right to remove unlawful, fake, misleading, abusive, or policy-violating content.

8. Cookies & Tracking Technologies

Cookies are used to maintain sessions, improve performance and security, personalize user experience, and analyze traffic. Disabling cookies may affect certain platform features.

9. Data Storage & Security

All data is stored on secure servers located in India. Reasonable security practices including encryption, access controls, and monitoring are implemented.

To the maximum extent permitted by law, BrandsForever shall not be liable for indirect or consequential damages arising from data breaches beyond reasonable control.

10. Data Sharing & Disclosure

With vendors (limited to review-related data)

BrandsForever does not sell or rent personal data.

11. Third-Party Links

The platform may contain links to third-party websites or services. BrandsForever is not responsible for their privacy practices or content.

12. Data Retention

User data is retained while the account is active. Upon deletion, data is deleted or anonymized subject to legal requirements. Vendor data remains public while listings are active.

16. Jurisdiction & Governing Law

This Privacy Policy shall be governed by the laws of India. All disputes shall be subject to the exclusive jurisdiction of courts in Jaipur, Rajasthan, India.

17. Relationship with Other Platform Policies

This Privacy Policy must be read in conjunction with the Terms & Conditions and the Refund Policies of BrandsForever.

By accessing or using the BrandsForever platform and by agreeing to this Privacy Policy, the user automatically agrees to and accepts the Terms & Conditions and Refund Policies, whether or not they are read separately.

18. Arbitration & Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to this Privacy Policy, the use of the BrandsForever platform, or the processing of personal data, shall be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996, as amended.

The arbitration shall be conducted by a sole arbitrator appointed mutually by BrandsForever and the user. In the event the parties are unable to agree on an arbitrator, the appointment shall be made in accordance with the provisions of the Arbitration and Conciliation Act, 1996.

The seat and venue of arbitration shall be Jaipur, Rajasthan, India. The arbitration proceedings shall be conducted in the English language.

The arbitral award shall be final and binding on all parties. Each party shall bear its own costs, unless otherwise decided by the arbitrator.

Nothing contained herein shall prevent BrandsForever from seeking injunctive or equitable relief from a court of competent jurisdiction to protect its intellectual property rights, data security, or platform integrity.

19. Policy Updates

BrandsForever may update this Privacy Policy from time to time. Continued use of the platform constitutes acceptance of the updated policy.
